Media Release - Desborough Town Council

Following the recent resignations from Desborough Town Council, statutory public notice will be given on 8th February 2018 to commence the process for filling the vacancies.

Any ten registered electors for each of the Desborough Loatland and Desborough St Giles Wards can submit a request in writing for the Returning Officer at Kettering Borough Council to arrange for elections to be held to fill the vacancies. The period in which such requests can be submitted ends on 28th February 2018.

If an election is called, the poll has to be held within 60 working days from the date of that public notice, which must include provision for the statutory election timetable to be incorporated within that period. This means that elections to fill the vacancies are likely to be held in April or early May 2018. If there are insufficient requests for elections to be held, then the Town Council are permitted by law to co-opt new members.

Currently, there are only two remaining elected members of the Town Council, which means that it is unable to conduct any business as this figure is below the minimum number required by its own Standing Orders for it to function. Consequently, in the interim, the Borough Council, under its powers outlined by the Local Government Act 1972 Section 91(1), is seeking to appoint sufficient independent persons as soon as possible to work on a temporary basis with the remaining Councillors to enable the Council to conduct any necessary and urgent business, until such time as new members are in place.

1. The legislation dealing with the filling of vacancies on Town Councils is the Local Election (Parishes and Communities)(England and Wales) Rules 2006, specifically Rule 5 and Schedule 2 Rules 1 and 2.

2. TownCouncils are also covered by the above rules.
